David Shirley born about 1760-65 possibly in Lenoir Co NC; He appears in St Thomas Parish, Cheraws District SC in the 1790 census and then again in the 1800 and 1810 Darlington Co censuses; he died about 1810-1820 in Darlington Co SC.

married Prudence Kelly. She was born ca. 1770; She appears as head of household in 1820, 30 and 40 Darlington Co SC census. She died about 1850 in Pike Co. AL. She was daughter of James Kelly who was born about 1736 Edgecombe Co. NC and died about 1790 Darlington Co. SC

1(i). Kelly Shirley born about 1788 in Chesterfield District (later Darlington County) SC; He died between 1815 and 1823; Kelly Shirley and William Kelly, 1st cousins, were sentenced to hang on April 17, 1812 in Darlington Co. SC for burglary. It is not known if the sentence was carried out.

1(iv). James Shirley born about 1795 Darlington Co. SC. James was a school teacher and farmer. He was blonde, small of stature, a good student, especially of the Bible. He died. Dec 31, 1863

1(v). Burrell Shirley born about 1797 Darlington Co. SC; He first appears in the 1820 Darlington Co census and then in many early 1820 deed records. He was charged with attempted murder in Oct 1829 in Darlington Co; He appears regularly in deed and census records in the 1830s, 40s and 50s; He was a member of Gum Baptist Church; He died March of 1863 Darlington Co. SC,


Darlington Co SC Stray

David Shirley born about 1795/6. He was age 55 in his application for bounty land in 1851 for service in the War of 1812, age 71 in 1866 Freedman' Bureau record. He enlisted in the War of 1812 in Snow Hill, Greene Co NC on 1 Aug 1814 and was discharged at Newbern NC in March 1815. David Shirley appears regularly in Darlington Co SC census (except 1830). In 1820 he was age 26-45, married with 1 daughter age under 10; In 1825 he was indicted for bastardy in Darlington. He was a private in the Seminole War in Florida in the late 1830s and appears in the 1840 Darlington Co census; In 1850 Darlington census he is head of household with Nancy Stokes (age 22) and Martha Stokes (age 10) residing. He states he lives in Darlington Co SC in his 1851 application for bounty land for service in the War of 1812. He died 4 March 1872 according to his War of 1812 documents

May 21, 1866 Freedmen’s Bureau Ration Book #3188, May – September 1866 - Rations issued to Poor & infirm persons etc.; 3. David Shirley (white), 71 years of age. Has a wife. Has a daughter of 11, two sons of six & four respectively. Lives near Lynches Creek about 18 miles west from Darlington. 10 days. {Issued for 3 days June 4th. Shows recommendation from O. D. Lee magistrate not satisfactory because of not stating facts within his personal knowledge. Sept. 11th -- brings certificate from O. D. Lee -- satisfactory.}

married Nancy Harrell on 16 August 1846 (source 1871 application for War of 1812 service benefits)

June 4, 1866 Freedmen’s Bureau Ration Book #3188, May – September 1866; 105. Mary Stokes (white). Widow. 27 yrs. of age. Has 4 children. Is a niece of David Shirley who drew rations on May 21st. Lives about 5 miles this side of Kellys bridge over Lynchs Creek. 18 miles distant from Darlington. Issued for herself & 4 children for 3 days. 3 days. {Issued for 3 days July 14th. Issued for 6 days July 21st.}

Kelley gdn - The Humble petition of Prudy A Kelly showith to your Honor that David Shirley departed this life some time in March 1872 leaving two minors, namely Edward and Burwell Joseph Shirley aged as follows - Edward ten years old and Burwell eight years old. Said named minors have no property of any kind whosoever and no one to take charge of tehir person having neither mother or [sisters marked out] relatives. Wherefore your petitioner prays your Honor to grant her letters of guardianship of said minor children as the children have been in her care since the death of their father and your petitioner will ever pray etc. Jany 6th 1873. Prudy A Kelley (note: Prudence A Kelly is the daughter of the elder David Shirley Sr)

2(iii). Burwell Joseph Shirley born about 1865, age 8 in 1873, named as a son of David Shirley dec'd in 1873 guardian record. He seems to be the Burrell J Shirley age 50 in 1910 and age 54 in 1920 Chesterfield Co SC census.
