1(iv). James Shirley
born about 1795 Darlington Co. SC. Served in the War of 1812 as a Private in the Company commanded by Captain L. McKiever in the Regiment S.C. Militia; He later received a pension for his military service; James was a school teacher and farmer. He was blonde, small of stature, a good student, especially of the Bible; While James Shirley was living with Winifred Johnston Shirley in Darlington, S.C., for some reason she left James and went to either Charlotte or Wilmington North Carolina and stayed with her family. (She had 6 brothers). When she returned to Darlington S.C. to James Shirley, she found him with a bastard son by a Mrs. Temperance Wingate whose maiden name was Hudson.(Rozier Shirley was born about 1831) James Shirley had custody of the child, a boy, named Rosier. He was reared by James and Winifred Johnston Shirley, but he kept his mother's name, Wingate. James gave his children a common grammar school education but educated Hamilton David through law school and college. Rosier was sent to college and was a professor of a school in Camilla Georgia, to be where his mother lived with him until she died. James was enumerated in Darlington Co SC in 1830 and 1840 censuses, in Pike Co AL in 1850 census, age 55 and was enumerated in Pike Co AL in 1860 census, age 65; He died. 31 Dece,ber 1863 (source: info from a descendant; however the education level of Rozier may be in doubt)

The State of Alabama - Pike County Know all men by these present that I James Shirley for and in consideration of the parental affection I have for my son Hamilton D. Shirley, do give and grant unto the lawful heires of the body of the said Hamilton D. Shirley that now are, and that may hereafter be born unto him, a certain negro boy named Randal, now about eighteen years old. Nor do I give the said negro to the said hires as an advancement of any part of my estate toward their father, H.D. Shirleys share of the same as one of my hairs at law, nor do I consider the lands I have hereto fore given and deeded to the heirs of my son Hamilton D. Shirley, as any advancement of his or towards his part of my estate, But I have given and do herein so assert the gifts by saying further, that, besides the more than ordinary parental affection, I have for my son Hamilton D. In the matter of the application of Tempy Shirley for a Pension. Personally came before me, a Notary Public &4 offices a Justice of the Peace in nad for aforesaid County and State, James Kelley aged Eighty years, a citizen of County of Pike, State of Alabama, whose Post Office
address is Linwood, Pike County Alabama, well known to me to be reputable and entitled to credit, and who being duly sworn, declares in relation to aforesaid case, as follows: That he (Affiant) was born in Darlington District, South Carolina in October 1799 - That he was raised in the same district and neighborhood with James Shirley, with whom he was intimately acquainted. That said James Shirley went into the war with Great Brittain in the United States service from said district & neighborhood, but cant recollect the year, but does recollect the circumstances well - several of affiants relatives (said Shirley being one of them) went into the same service from the same neighborhood, at the same time & they served either three or six months & all returned home from the said service at the same time & to the same neighborhood - That his best recollection is that said Shirley was ___? That he well remembers, that at the time he went into said service there was a good ____? of excitement in said neighborhood s\about drafting soldiers & that some of his (officers relatives who expected to be drafted were not drafted, but that several other of ___? relatives were drafted & James Shirley among them & they all went off to the service (as by ___? stated) together & all returned together - That it was generally reported, understood & ____?in said district that said Sherley went into the United States service in said war - That affiant _____? District when about 18 years of age & moved to __________? never ? years 17 & they came to Pike County Alabama where he has resided continuously till the present time - upon the same tract of land - That said Shirley came to the same neighborhood about 15 years afterwards & lived in the same neighborhood in said Pike County until his decease which took place some ten or twelve years since but was not present at his death or at his funeral - That said Shirleys first wife died some 15 years after coming to said Pike County Ala. That he is well acquainted with said James Shirley 2nd wife Tempy. She who is now his widow & that she has never remarried since the death of said James Sherley. & he further declares that he has no interest in said case, and that he is not concerned in its prosecution.

"My Granddaddy, Lewis Garner Wingate, son of Rosier Shirley Wingate, told my mother Pearl Wingate and uncle James Woodrow Wingate, that Rosier was raised by James Shirley and his wife Winnefred but he was known as Rosier Shirley until he left Alabama and went to Georgia. "found" his mother and half brothers John and Jackson Wingate, and decided it proper to change his name to Wingate.....this was just "done"....no lawyer....no official record...just suddenly he was Rosier Wingate instead of Rosier Shirley....I also have confirmation of this by cousins that say they were told the same information by their parents (siblings of my mother/children of my grandfather)."
