Generation No. 1

1.  WALTER1 SHIRLEY was born May 27, 1690 in most likely England, and
died 1755 in Frederick County, Virginia.  He married DORCAS AVIS,
daughter of ROBERT AVIS and ANN JARVIS.  She was born November 21, 1708
in Port Republic, Calvert County, Maryland1, and died in Frederick
County, Virginia.

Notes for WALTER SHIRLEY:
The first documented evidence of Walter Shirley's presence in America is
his appearance on a 1733 list of taxables in St. Leonards Creek Hundred,
Calvert County, Maryland.  This list is reproduced on pages 377-8 of "A
History of Calvert County Maryland" by Charles Francis Stein, published
1976 in cooperation with the Calvert County Historical Society.  Walter
is found at page 378 (his name does not appear in the index).  Also in
the St. Leonard's Creek Hundred list of taxables (at page 377, and not
listed in the index) are "at Robert Avis' -Jarvis Avis, Robert Avis,
Jun,"  the father and brothers of Dorcus Avis who married Walter Shirley.

Walter Shirley first appears in the records of Virginia thus far located
by this writer in "Court Orders of Frederick County, 1743-1745," Vol. I,
page 294. There he is found to have sued William Jay for the sum of "One
pound Sixteen Shillings" at a court held for Frederick County "...on
Saturday the 9th day of March, 1744"  (Walter won as Wm. Jay failed to
appear).  Walter appears in the records of the Frederick County Court on
two other occasions where suits he brought were discontinued because
agreement with the defendants were reached (Aug., 8, 1746 and Jun., 8,
1748).

In "Court Orders and Petitions of Frederick County, 1748-1751," Vol. III,
page 46, it is noted that on March 7, 1748, "Walter Shirley is hereby
Appointed Constable in the room of Samuel Walker, and it is Ordered that
the Sheriff Summon him to appear at the next Court to be sworn into the
said Office accordingly."

In the Northern Neck records of the Virginia Land Office, held by the
Virginia State Library, there are three grants of land by Thomas Lord
Fairfax to Walter Shirley.  They are: 1) 404 acres granted 13 Oct 1750
(Book G, p. 438),  2) 311 acres granted 20 Jun 1751 (Bk. H, p. 3--this
grant surveyed by George Washington), and 3) 472 acres granted 18 Nov
1752 (Bk. H, p. 226).  The total of these acreages is 1,187, a fact that
has caused some confusion among Shirley researchers, since Walter
bequeathed only 783 acres of land in his July 10, 1755 Will (Frederick
Co. Will Book, Vol 2, page 175).  According to his Will the 783 acres he
bequeathed constituted "the full quantity contained in two separate deeds
obtained from the Right Honorable Lord Thomas Fairfax."  Any question
concerning how much land Walter Shirley actually obtained from Lord
Fairfax can be easily resolved by comparing the land description
contained in the 1750 with that of 1752 grant.  That is, it can be seen
that they are both one and the same property, the 1752 deed being a
re-survey of the 1750 grant.

In Walter Shirley's Will (source cited above) he divides his land between
sons Walter, Jarvis, James, and Robert, and his "moveable estate" between
them and his daughters Sarah and Dorcas.  In a Codicil to his Will Walter
gave 60 acres of land out of the 183 originally given to son Robert, to
his "..well beloved friend and brother Francess Avis" for "..the good
will I bare to him, and more especially that he may live near my said
wife [Dorcus] to be their friend and councilor seeing that my said son
[Robert] have a good schooling and learning."

A very interesting and sadly humorous Accounting to the Court of charges
to Walter's estate may be found in the Frederick County, Virginia, Will
Book 3, page 125. 

Notes for DORCAS AVIS:
A record of the birth of Dorcus and her sister Jane and brother Jarvis
may be found in the International Genealogy Index (IGI) of the Church of
Jesus Christ of Latter-Day Saints (Mormons).  They are in the IGI of Port
Republic, Calvert County, Maryland, and are taken from the records of the
Christ Church.

2.  WALTER2 SHIRLEY, JR. (WALTER1) was born Abt. 1728 in Maryland (?),
and died 1805 in Jefferson County, West Virginia.  He married (1) HESTER
VANCE, daughter of JAMES VANCE and MARY HOGUE.  She was born Abt. 1738,
and died Abt. 1784.  He married (2) MARGARET (UNKNOWN) Abt. 1798.  She
was born Abt. 1757, and died February 19, 1829 in Belmont County, Ohio2.

Notes for WALTER SHIRLEY, JR.:
For many years after his father's death Walter Shirley lived on the
parental plantation near Keyes Ferry, and then later near Charles Town,
West Virginia, where he died in April 1804.

Walter served in Rutherford's Rangers at the time of the French and
Indian War (Hening's Statutes at Large, Vol. 7, p. 215).  The following
notation appears in the records of the Virginia Land Office, Richmond,
Virginia, in French and Indian Bounty Warrants, Vol. 2, p. 537:

"Berkeley Sct.        March Court, 1780
"Walter Shirley personally appeared in Court and made oath in the holy
Evangelist of Almighty God that in the year 1758 and 1759 he served as a
soldier in a company of Rangers Commanded by Captain Robert Rutherford
and embodied under an Act of the Assembly of Virginia until it was
Reduced and that he hath never Received any Land for his services under
the King of Great Britain's Proclamation of 1763 the above affidavit was
Supported by a Certificate under the hand of said Robert Rutherford which
is Ordered to be Certified.
"Teste      Will Drew Cl. Cur.
"No. 14 Walter Shirley 1064"

An extensive history of Rutherford's Rangers by Colonel Robert L. Bates
may be found in Vol. 4 (1938), page 4, of "The Magazine of the Jefferson
County Historical Society."  Walter and his brothers James and Jarvis are
mentioned.

It is believed that  Walter's wife Esther (or Hester) died not long after
the birth of their last child Lawrence Vance Shirley (b. ca.1785).

Walter married 2nd to Margaret Riley, widow of Richard Riley.  That
Walter did so is based on the following: 1) a deed executed by "Walter
Shirley and Margaret his wife" dated February 9, 1804 (Deed Book 2, page
111, Jefferson County, West Virginia), and witnessed by "Martha Arendorf"
who was mentioned in Walter's Will as his housekeeper. 2) A Berkeley
County newspaper article dated February 19, 1829, which states that "Mrs.
Margaret Shirley, aged 72 years, relict of Walter Shirley, formerly of
Charlestown, Jefferson County, Virginia" died at the residence of Richard
Riley [her son] in Belmont County, Ohio. 3) In a private publication
called "The Riley Manuscripts," a history of the Richard Riley family
gathered by Jesse Keyser Riley of Bealsville, Ohio, it is noted in the
family records of Ephriam Shirley, by his son Benjamin F. Shirley in
1912, that Margaret Riley "married Walter Shirley, Samuel Shirley's
father."

Walter's Will is recorded in Will Book 1, page 205, Jefferson County,
West Virginia.  In it he leaves his land to sons James and Lawrence, on
the express condition that they together pay son Samuel the sum of
"twenty five pounds currency" within one year of his death.  The
remainder of his estate was to be equally divided between his "son David
and my daughters Elizabeth French, Nancy Campbell, Margaret Wysong, and
Mary Barton."  His last request was that his housekeeper Martha Arendorff
[probably Orndorff] be moved with her property to her home in Loudoun
County at no expense to her.  Wife Margaret is not mentioned in the Will.
 Walter's brother Robert and son-in- law Michael Wysong were made his
executors.



Notes for HESTER VANCE:
The approximate year of Hester (Vance) Shirley's death is established by
the Vance Family Historian Rose Barton Tyler who asserted (in 1925) that
Hester's daughter Mary Shirley was aged three years when Hester died.
Mary Shirley, who later married to Dr. Hugh Barton, was born April 11,
1780.  Mary Shirley was alledgedly raised by an Aunt, Margaret (Vance)
Snapp

According to Robert L. Bates in "The Story of Smithfield (Middleway),
Jefferson County, Virginia,"
David Shirley resided in Jefferson County, Virginia.  He served as a
ensign in the Revolutionary War, under Captain Russell.  He was killed by
a man named Thompson."

3.  JARVIS2 SHIRLEY (WALTER1) was born Abt. 1730 in Maryland (?), and
died 1818 in Jefferson County, West Virginia.  He married SARAH
(UNKNOWN). 

Notes for JARVIS SHIRLEY:
Jarvis Shirley resided near Charles Town, West Virginia.  He was a ranger
in Captain Robert Rutherford's command at the time of the French and
Indian Wars, as were his brothers Walter and James (Jarvis may be found
in Henning's Statutes at Large, Vol. 7, page 216).  His assertion of
service (attested to by Robert Rutherford) may be found in French and
Indian Bounty Warrants, Vol. 2, page 418, Land Office, Richmond,
Virginia.

The Will of Jarvis Shirley, dated December 18, 1813, is recorded in
Jefferson County, Virginia, Will Book 3, Page 177.  In it he gives to his
sons William and Ephriam 50 acres of land to share alike, subject to "the
payment of one hundred pounds to Elizabeth Smallwood, and one hundred
pounds to Rebecca Gardner as hereinafter devised to my said two said
daughters."  A daughter Mary, said to be "somewhere in the Western
Country" and "intermarried  with Richard Miller," is bequeathed "Two
hundred dollars."  All the sums of money were to be paid by William and
Ephriam to their sisters as a condition of their receiving the 50 acres
of land, and out of which the money for payment was to be devised.

On May 25, 1818, Jarvis Shirley deeds to his sons Walter and Jarvis Jr.
"one hendred acres of land, be the same be more or less situate in the
said County of Jefferson, being the residue of the tract on which I now
reside (having given unto my sons William Shirley & Ephriam Shirley fifty
acres) also all my stock of every description whatever, all my household
& kitchen furnature and all my farming utinsels."  He reserved "unto
myself & my wife Sarah the possessions use and enjoyment of all the said
property during our natural lives."  See Jefferson Co., WV, Deed Bk. 10,
p. 387.  Jarvis Shirley's Will was proved June 28, 1819.

4.  JAMES2 SHIRLEY (WALTER1) was born Abt. 1732 in Maryland (?), and died
Abt. 1785 in Berkeley County, (West) Virginia.  He married MARY
(UNKNOWN). 

Notes for JAMES SHIRLEY:
James Shirley, with his brothers, lived on the parental plantation near
Keyes Ferry, later named Millville, (West) Virginia.  On March 8, 1773,
James undertook to break the entail of his father's Will by conveying his
property to Thomas Rutherford.  James's brothers united with him in this
effort, and clear title to James' land passed to Thomas Rutherford on
September 15, 1774.  This Deed is recorded in Deed Book 3, page 8, in
Martinsburg, West Virginia,

James Shirley served in the French and Indian Wars under Captain Robert
Rutherford, as did his brothers Walter and Jarvis.  In 1780 James made
application for a Bounty Land Warrant for the services he rendered in
1758 and 1759 (see: French and Indian Bounty Warrants, Vol. 2, p. 356,
Virginia Land Office, Richmond, Virginia),

In Old Military and Importation Warrants, Vols, 1, 2 and 3, p. 862,
Virginia Land Office, Richmond, Virginia, may be found the following:

"Land Office Warrant, No. 1064
To the principle surveyor of any county within the Commonwealth of
Virginia: This shall be your warrant to survey and lay off in one or more
surveys, for James Shirley his heirs and assigns, the quality of fifty
acres of land, due to said James, for military service performed by him
as a soldier in the late war between Great Britain and France according
to the terms of the King of Great Britian's proclamation of 1763 a
certificate of which Duly proven is received into the land office on this
25th day of May in the year of one thousand seven hundred and eighty."

The land James acquired was "in the County of Monongalia on the West side
of the Little Kenhawa."  He later signed over the land to Robert
Rutherford. This assignment was certified by Patrick Henry, Governor of
the Commonwealth of Virginia on July 5, 1785, and is noted in a
continuation of the record cited above.  It was apparently during this
same year that James Shirley died, since his name disappeared from the
1785 tax rolls of Berkeley County.

Patience (unknown) Shirley sold her Dower Right to the property owned by
son Walter to Michael Wysong on November 9, 1814 (Jefferson County Deed
Book 9, Page 473).

On January 18, 1819 Robert Shirley sold his share of land inherited from

Virginia Deed Book 11, Pages 1 and 2).

Notes for ELIZABETH SHIRLEY:
Elizabeth (Shirley) Hibben lost the land inherited from her father to
satisfy the debts of her husband Cyrus.  The property was sold at a
Sheriff's sale and purchased by James Lock on September 9, 1818 (Deed
Book 10, page 385, Jefferson County, WV).  Elizabeth later sold her Dower
Right to the property to James Lock on October 31, 1822 (Jefferson County
Deed Book 12, Page 354).

6.  ELIZABETH3 SHIRLEY (WALTER2, WALTER1) was born Abt. 1764 in Virginia.
 She married SAMUEL FRENCH. 

Notes for ELIZABETH SHIRLEY:
It is reported that Elizabeth and Husband Samuel French moved to Western
Ohio.

7.  NANCY3 SHIRLEY (WALTER2, WALTER1) was born Abt. 1765 in Virginia.
She married JOHN CAMPBELL August 31, 1789 in Shenandoah County, Virginia,
son of RICHARD CAMPBELL and REBECCA HAWKINS. 

Notes for NANCY SHIRLEY:
John and Nancy (Shirley) Campbell for some years resided in Martinsburg,
Virgina (now West Virginia).  They later moved to St. Louis, Missouri.

8.  JAMES3 SHIRLEY (WALTER2, WALTER1) was born Abt. 1770 in Virginia, and
died in Ohio.  He married SUSANNA STRODEMAN May 12, 1794 in Berkeley
County, (West) Virginia7. 

Notes for JAMES SHIRLEY:
The marriage of James Shirley and Susanna Strodeman is found at page 204
of  "Marriage Records of Berkeley County, Virginia. 1781 - 1854,"
compiled by Guy L. Keesecker.  James' name is there spelled as "James
Shiely."

On October 24, 1806, in the year following his father's death, James
Shirley and his wife Susanna sold the land inherited from him.  The deed
of sale is recorded in Jefferson County, West Virginia, Deed Book 4, Page
26, and reads in part: "...by these presents, the said James Shirley and
Susanna his wife have granted, bargained, and sold, and by these presents
doth grant, bargain, and sell unto the said Mangus Tate, Jr., and his
heirs One moiety or equal half part in quality and quantity in a tract of
land lying in the County of Jefferson, which tract of land was on the
eleventh day of April, one Thousand Eight hundred and four devised by
Walter Shirley now decd. to the said James Shirley and Lawrence Shirley
as tenants in common..."  The original acreage devised in his Father
Walter's Will to he and brother Lawrence was  "about 90 acres."

It is believed that James and his son David, went to Ohio in 1819
probably in the company of Robert Shirley (son of James, son of Walter
Sr.) and his son James.  James and David ended up in Ross County, cousins
James and Robert ended up in Defiance and Paulding County, Ohio, in 1821.

It seems that James Shirley and his son David fell on difficult times not
long after their arrival in Ross County.  The first reference to James'
difficulties include son David (David's earlier  difficulties are
describe in his notes).  In the September Court of 1823 a one John McCoy
filed suit against James and son David claiming that in March, 1823,
"Defendants David & James jointly and severally promised to pay sixty
days after the promissory note to the said John McCoy on order one
hundred and fifty two dollars, fifty six cents, and one fourth of a
cent."  "And that though often requested...not regarding their said
promises"  they "contrivingly and fraudulently intending craftily and
subtly to deceive and defraud said plaintiff."  McCoy claimed $300.00
damages for their failure to pay.

James and David's attorney filed a statement claiming "that they did not
assume and undertake in any manner and form as the said plaintiff.."
charged in his complaint. Unfortunately, a note signed by David, and
"Xed" by James was produced.  In this promissory note the original
$152.56 amount was reduced by $1.12 in return for "1 skillet lid."
Having apparently lost in court, on September 10, 1925, son David and
uncle Lawrence (his father's brother) assumed an obligation to McCoy in
the amount of $205.12.

It has been said by a descendant of James' cousin that James and David
were "fond of gaming," so perhaps the above may have been a gambling
debt.  In any case, it is unknown to this writer if anything of value
other than one skillet lid went to Mr. McCoy.

Virginia, and died February 16, 1824 in Jefferson County,  West
Virginia8.  She married MICHAEL WYSONG, son of JOHANN LUGWIG RHEINHARD
WEISANG.  He was born February 12, 1767, and died April 04, 1849 in
Jefferson County,  West Virginia8.

10.  SAMUEL3 SHIRLEY (WALTER2, WALTER1) was born Abt. 1775 in Berkeley
County, Virginia, and died Abt. 1842 in Caldwell County, Kentucky.  He
met (1) MARY ELLEN RILEY, daughter of RICHARD RILEY and MARGARET
(UNKNOWN).  She was born March 01, 1777 in Charles Town, (West) Virginia,
and died Abt. 1797 in Berkeley County, Virginia.  He married (2) PHOEBE
COOK Abt. 1808 in Blountville, Sullivan County, Tennessee.  She was born
Abt. 1784 in New York, and died Abt. 1842 in Caldwell County, Kentucky.

Notes for SAMUEL SHIRLEY:
It has been said of a descendant of Samuel Shirley and Phoebe Cook that
Samuel was a tryer and tester of arms for the Army at Harper's Ferry,
Virginia.  At a fairly early age he departed for Blountville in Sullivan
County, Tennessee, with his brother in law Dr. Hugh Taylor.  From there
he ended up in Caldwell County, Tennessee.

Notes for MARY ELLEN RILEY:
In Unrecorded Deeds No. 1, Page 450, Berkeley County, West Virginia,
there is a deed dated August 13, 1791, between Charles Washington
(brother of George) and Mary Riley.  Mary is identified in the deed as
"daughter of Margaret, and Rich'd Riely deceased."  For the sum of
fifteen pounds Charles Washington and his wife Mildred sold a town lot
number 51 in Charles Town to Mary. It is interesting to note that at the
time of the sale Mary Riley was a girl of 14.

Mary Riley died at age 20, unmarried giving birth to Ephriam Benson
Riley.  The fact that Mary was unmarried and the father of Ephriam Benson
Riley is clearly established in a Deed found in Deed Book 21, Page 260,
of Jefferson County, West Virginia, dated September 10, 1836.  This Deed
is between "Ephriam Shirley, alias Riley, and Leodocea his wife of Ohio,"
and Andrew Hunter of Jefferson County.  The land they were selling was
town "lot No. 51, being the same lot which was sold and conveyed by deed
bearing date on the 13th day of August 1791 and duly recorded in the
Clerk's Office in the County of Berkeley, from Charles Washington, and
Mildred his wife, to Mary Riley, daughter of Margaret and Richard Riley,
the above named Ephriam being the only child and heir of said Mary Riley,
who died intestate, and the said Ephriam having assumed the name of his
reputed father (Shirley)".   Ephriam is named "Ephriam Shirley alias
Riley"  some nine times in this deed and its associated certifications

It has been speculated by numerous Shirley researchers who may have been
the father of Mary's child Ephriam Benson Shirley, alias Riley.  It seems
certain that Samuel Shirley fathered Mary's son Ephriam in view of a
letter written September 9, 1912, by Ephriam's son Benjamin F. Shirley to
Richard Riley.  In this letter Benjamin writes "Ephriam Shirley, my
father, told me his father and my grandfather was Samuel Shirley, and
that his grandfather [was] Walter Shirley."  He further writes that
"Samuel, Ephraim's father, moved to a place called French, Broad County,
Tennessee."  Samuel Shirley departed for Tennessee with his
brother-in-law Dr. Hugh Barton about the time of Ephriam's birth and
Mary's death.

Samuel Shirley was the son of Walter Shirley, Jr. (as indicated in his
notes, Walter married second to Mary's mother, widow Margaret Riley).

12.  LAWRENCE VANCE3 SHIRLEY (WALTER2, WALTER1) was born Abt. 1784 in
Frederick County, Virginia.  He married ELIZABETH HAYNES May 25, 1808.
She was born Abt. 1791, and died Abt. 1839.

Notes for LAWRENCE VANCE SHIRLEY:
Lawrence Shirley sold the 50 acres of land he "became entitled to under
the last Will and Testament of his deceased father Walter Shirley."  The
Deed is dated April 6, 1808, and describes Lawrence as "now of the County
of Ross in the State of Ohio" (Deed Book 7, Page 515). He was paid the
sum of $575.00 for the property.  In a second Deed dated February 16,
1812, it appears that the same property [50 acres] is again sold to the
same individual (Mangus Tate) for the same amount ($575.00)  This Deed
appears at an earlier page in the Deed Book(108), but was made at a date
later than the first.

A possible explanation for there being are two Deeds for the same
property may lay in the fact that the earlier one was between Lawrence
Shirley and Mangus Tate alone, and was not recorded until May 24, 1813.
Evidently in order to be binding at the time of recording a wife must
also be named in the Deed. Lawrence and Elizabeth Haynes were married on
May 25, 1808, after the first deed was executed, but well before it was
recorded.  Thus the second Deed is between "Lawrence Shirley and
Elizabeth his wife" and Mangus Tate.

As noted in the Deeds above, Lawrence Shirley and his wife were residing
in Ross County, Ohio, before 1808. On May 1, 1813, Lawrence volunteered
for service with a Rifle Company of the Ohio Militia, commanded by Joseph
Chew.  A portion of his application for a War of 1812 Bounty Land Grant
dated April 5, 1851, reads as follows:

"...he served in this enlistment about one month, and that he was
honorably disbanded, and that neither he nor the rest of the company
received a written discharge...afterwards enlisted in the Quarter Masters
Department at Franklinton on the Scioto River sometime in the Month of
June, AD 1813...for a term of three months, and continued in actual
service nearly the full term, being released and allowed to return home a
few day before the expiration of his service account of sickness in his
family."  He was released at Basher Mills, North Fork of Paint Creek,
Ohio.  At the date of this application he is shown to be "..aged 66
years, a resident of Middleport, County of Iroquois and State of
Illinois."

Lawrence was still attempting to obtain his Bounty Land Grant on June 11,
1855, and at that time was residing in Miami County, Indiana.  It is not
know by this writer if he was successful in obtaining a grant.

Berkeley County, (West) Virginia.    He married (2) NANCY MAYER October
10, 1811 in Berkeley County, (West) Virginia10.  She was born June 24,
1783, and died April 30, 1864 in Charles Town, (West) Virginia11.

Notes for WILLIAM SHIRLEY:
William Shirley sold his share of the land bequeathed to him and brother
Ephriam by their father Jarvis to their brother Walter on November 15,
1824 (Jefferson County Deed Book 13, Page 214).

On April 13, 1807 William and 1st wife Charlotte sold Charles Town Lot
No. 52 to John Anderson for $250 (Deed Book 4, Page 340).  On May 11,
1809 they sold their house and Lot No. 50 in Charles Town to Theophelis
Buckmaster for $400 (Deed Book 5, Page 152).  William evidently
speculated in Charles Town property as there are a number of Deeds in
which William bought and sold town lots.

William's obituary appeared in the August 26, 1833 edition of the
"Alexandria Gazette," and reads as follows; "In Charlestown (Jefferson
County,) Va., on Monday last. after an illness of a few hours, Mr.
William Shirley, aged about 60.  The deceased was an affectionate
husband, indulgent parent, kind neighbor, and an honest man.  With such a
citizen we part with regret; and sincerely do we sympathize with the
remaining members of the family - a wife and daughter - who but two weeks
since deprived of an only son and brother, by a like dispensation of
providence."

Notes for NANCY MAYER:
In her Will of December 6, 1837 (Jefferson County, WV Recorder Will Book,
Page 79) Nancy names her Daughter Charlotte Jane Starry, and Charlotte's
children William Shirley Starry and Justine Lee Starry as benificiaries
of her Estate.  In this Will she remarks that she is "..about to remove
for a time to the Western Country from whence I may not return."

It is obvious from her Will that Nancy had no use for Charlotte's husband
Joseph Starry.  In her Will Nancy directs "that in no event is Joseph
Starry the husband of said Charlotte Jane to have any interest in or
control over my said estate."  Nancy also provides that in the event
Joseph Starry should become guardian of Nancy's children in their
infantcy, the Estate was be retained in the hands of the executor and "in
no manner" was Joseph permitted to interfere   Moreover, should Charlotte
and her children all die before Nancy, then all her Estate was to go to
her next of kin "so as to exclude the said Joseph Starry from
participating therein."

Notes for EPHRIAM SHIRLEY:
Ephriam Shirley was a ensign in the 2nd Battalion, 55th Regiment of
Virginia Militia in 1812, and resigned April 1813 (from unclassified
documents in Virginia State Historical Library).

Ephriam Shirley, the son of Jarvis Shirley, is often confused by Shirley
researchers with the Ephriam Benson Riley, son of Mary Riley, who took
the name of his reputed father (see notes of Ephriam Benson Riley, alias
Shirley).  Ephriam Shirley, son of Jarvis, married Margaret Tomlinson,
and Ephriam Benson "Shirley,"  son of Mary Riley, married Leodocea
Steenrod.

It may be clearly established that these are two different Ephriam
Shirleys, and not one individual who married twice, by a reading of the
Will of Ann Butcher, the Aunt of Margaret Tomlinson.  In her Will dated
March 1, 1826, she bequeaths certain items and property "to my Niece
Margaret N.[?] Tomlinson, widow of the late Ephriam Shirley of Charles
Town, West Virginia." The Ephriam Shirley that married Leodocea Steenrod
did not die until March 18, 1883, at age 87, some 57 years after Ann
Butcher describes her niece Margaret as a widow of the Ephriam of Charles
Town. The Will of Ann Butcher may be found in the records of Orphans
Court for the City of Alexandria, Virginia, 1821-31, Book No. 3, Pages
224-7.

Ephriam Shirley (son of Jarvis) still lived in 1821 as shown by an
indenture executed by him and wife Margaret.  The indenture was a 30 day
note totaling $760.85. Failure to pay would cause the sale of his
property put up as security.  The indenture, dated March 1, 1821, may be
found in Jefferson County, West Virginia, Deed Book 2, Page 362.

1822 as the year Ephriam Shirley (son of Jarvis) death is arbitrarily
assigned by this writer.

Will Walter make bequests to wife Mariah, and to his daughter "Sarah
Rebecca Shirley (now married to George W. Briscoe)."  He also make
bequests to the heirs of his deceased brothers Ephriam and Gervis
Shirley, and his deceased sister Rebecca (Shirley) Gardner.  Another
bequest is to "Mrs. Mary Rochabaugh," who is believed by this writer to
have been Walter's sister Mary, married 2nd, either after the death of or
divorce from Richard Miller.

Notes for JAMES SHIRLEY:
When a young man, and about the time of his father's death, James Shirley
moved to the vicinity of Smithfield, Virginia (now Middleway, West
Virginia).  He owned large properties, and continued to add to his
possessions during his life, and died owning a large estate.

James Shirley's Will is recorded in Jefferson County, West Virginia, Will
Book 9, Page 409.  In it he gives his wife Matilda one third of his
estate "both real and personal,"  stipulating that after her death her
Dower was then to be equally divided between his sons Robert, George
William, and Thomas Lee.  The remaining two thirds of his holdings were
distributed to sons Robert, George and Thomas.  At his death James
Shirley owned numerous tracts of land amounting to considerable acreage.
A Plat of some of James' extensive holdings may be found in Will Book
Book 24, Page 309, of  Jefferson County.

James gave his sons several slaves by name.  All other slaves not named
in the Will were to be equally divided among them (in an estate
accounting all are named).  James did will that "my yellow boy named
James Rust shall be free at the age of twenty one years at which time my
executor hereafter named shall out of my estate furnish him with two good
suits of clothes of good quality, and twenty five dollars in cash."  In
the accounting of the estate the cost of Mr. Rust's two suits of clothing
came to $57.54 (W.B. 10, p. 11). To his daughter Mary Hurst he gave "two
Negroes by name Jerry and Lucy," and $1,000.00 cash.

Matilda to her home in Jefferson County where she met and later married
Mary's father James.  It is said Mary and her brother James disapproved
to their father's marriage because of Matilda's age (they were about the
same age as their new step-mother).

In Robert L, Bates "The Story of Smithfield (Middleway), Jefferson
County, West Virginia," it is said that "Timothy Shirley, at the time of
the War of 1812 was a militiaman in Captain Joseph Grantham's Company,
2nd Battalion, 55th Regiment of Virginia Militia.  In his early days,
Timothy Shirley was reputed to be an athlete, taking pride in his
wrestling prowess."

Timothy Shirley's Will was presented in Probate Count of Brown County,
Ohio, on September 4, 1861, designated as Will No. 221.  In it he names
his grand children Justinian Garland Shirley, Mariah Winter Shirley, and
Wilshire Shirley.  Named as living with him was Sarah Burbage. Timothy
also names his son William Shirley, and daughters Isabella and Sarah
Shirley.  Witnesses to Timothy's will were James Wright and William
McColgin, with James Wright named as Executor.

Notes for JOHN SHIRLEY:
This John Shirley is identified as the son and heir  of Robert Shirley in
a 12 Aug 1813 Indenture found in Deed Book 8, Page 251.  In a 15 Oct 1817
Indenture found in Deed Book 10, Page 249, John acquired his Mother
Patience's Dower Right to the land of her husband and his Father for
payment of purchases made by him for her at Robert's Estate Sale.  By
Indenture dated 30 Mar 1818 (Will Book 10, Page 265) John sold the
property conveyed to him "...by Patience Shirley, his mother."

John Shirley probably died early in the year 1822.  An appraisment of the
Estate of "John Shirley, Dec'd" was made March 6, 1822 (Will Book 3, Page
454), and an accounting of its sale was made on March 22, 1822 (Will Book
5, pages 282-283).

According to Julian Campbell of Hermosillo, Sonora, Mexico, a descendant
of James M. Campbell, Dr. Campbell married a Mexican woman, and was known
there as Santiago instead of his Christened name James.   Julian states
that in a newspaper of January 1865 it is reported that "..the past
December 30 died in Huepac, Sonora, Mexico Mr. Santiago M. Campbell, a
good doctor and father of a big family.  He was a good man who became a
Mexican."

That James (Santiago) Campbell was a Doctor is further established by
Mexican Civil birth records which are "..from Dr. Santiago M. Campbell
from St. Louis, Missouri."

Notes for DAVID SHIRLEY:
It appears that David Shirley managed to get into trouble shortly upon
his arrival in Ross County, Ohio.  In the April 1920 term in the Ross
Court of Common Pleas may be found the following:

"The Grand Jurors of the state of Ohio, empaneled and sworn to enquire of
crimes and offences, committed within the body of Ross County aforesaid,
in the name and by the authority of the state of Ohio aforesaid, upon
their oath present, That Andrew Mace, Ephriam Ougheltree, Jesse Mace,
Abner Kerny, David Shirley, Isaac Mace, William Dillon, late of the
county of Ross aforesaid, together with divers other evil disposed
persons to the number of seven and more (to the grand jurors yet unknown)
on the twenty fifth day of November in the year of our Lord one thousand
and nineteen with force and arms at Union township. in the county of Ross
aforesaid, and within the jurisdiction of this court, did unlawfully,
riotously and routously assemble and gather together to disturb the
public peace, and so being then and there assembled and gathered together
in and upon one James Anderson in the public peace, then and there being
unlawfully, riotously and routously did make an assault, and him the said
Anderson then did beat, wound and ill treat, and other wrongs to the said
Anderson then and there unlawfully, riotously routously did, to the great
damage of the said Anderson contrary to the statute in such case made and
provided and against the peace and dignity of the state of Ohio."

David and the others named above were ordered arrested on July 16, 1820.
They pled not guilty at their trial in August, 1820.  In the course of
their trial it was discovered that a one David Anderson (probably a
relative of the abused James) was found to have sold whiskey without a
licence (no doubt to the accused rioters), which apparently was enough of
an extenuating circumstance for the Jury to find David and fellow
defendants not guilty,

On September 29, 1823, David Shirley sued a one John Hall for $66.12.  As
witnesses in his action he called "Nathan Shirley [his 2nd cousin], James
Shirley [his father], Ira Davenport, Ozwell Thompson, Edward Gardner,
Lawrence Shirley [his uncle] and Benjamin Jones."  David won his suit,
but only in the amount of $22.25 and the cost of the suit.  David
assigned his judgement to father James.

David is last found in the 1850 Census of Defiance County, Ohio, as
family No. 742.  His wife Mary (Clifton) and daughter Susan (who later
married Rufus Peck) reside with him.  Living next to him (family No. 741)
are his son John J. Shirley and family.

Notes for EPHRIAM BENSON RILEY, A.K.A. SHIRLEY:
That this Ephriam Shirley was the child of his unwed mother Mary Ellen
Riley is established by a land deed dated September 10, 1836, found in
Deed Book 21, Page 260, at Charlestown, Jefferson County, West Virginia.
This indenture is "between Ephriam Shirley, alias Riley, and Leodocea his
wife of Ohio" and Andrew Hunter of Jefferson County.  The land being sold
is a lot in Charlestown "...which was sold and conveyed by deed bearing
date on the 13th day of August 1791 and duly recorded in the Clerk's
office of the County of Berkeley [Unrecorded Deeds No. 1, page 450], from
Charles Washington [brother of George Washington], and Mildred his wife,
to Mary Riley, daughter of Margaret and Richard Riley, the above named
Ephriam being the only child and heir of said Mary Riley, who died
intestate, and the said Ephriam having assumed the name of his reputed
father (Shirley)."  His father was Samuel Shirley (see Mary Ellen Riley
notes). Mary Riley died in childbirth.

Ephriam was born in his mother's small stone house then located one half
mile out of Charlestown on the Martinsburg road.  The newborn Ephriam was
raised to manhood by his grandmother, the widowed Margaret Riley, who
later married 2nd to Walter Shirley, father of Samuel Shirley.

There is some concern that Ephriam's middle name may have been Benjamin,
instead of Benson as believed by some researchers.

Bolivar, Tennessee. 

Notes for ROGER BARTON:
The following is said to be from an undated and un attributed newspaper
clipping:  "Roger Barton was born in Tennessee, near Knoxville, in 1802,
and received a good classical education in east Tennessee and studied law
at Knoxville in 1824 under William E. Anderson and after a practice of
several years there removed to Bolivar, Tenn., and formed a partnership
with Judge V. D. Barry of that place.  He was a member of the Tennessee
Legislature and also as Attorney-General of Tennessee, which office he
filled with distinguished ability.  He moved to Holly Springs, Miss., in
1833 and formed a partnership with Honorable Joseph W. Chalmers.  He was
elected to the Legislature of the State in 1838 and again in 1849.  He
became at once a leader.   He competed almost successfully with Jefferson
Davis for the United State Senate, and it is stated that he would have
probably defeated Mr. Davis, but for the military glory of the latter,
who had just returned from Mexico.  Roger Barton was a remarkable man and
it is stated that for more than 20 years he was a leader of his party in
North Mississippi and had he been inclined to office he could have had
anything within the gift of the people...."

Charles Shirley's obituary appeared in the August 2, 1897 edition of "the
Alexandria Gazette."  It reads: "Mr. Charles Shirley, one of the oldest
residents of this city, died at his home, on Royal Street, near King,
shortly after 2:00 o'clock this morning in the 81st year of his age.  The
deceased had been blind for some time.  Mr. Shirley for many years held a
government clerkship in Washington.  He was at one time during the war a
member of the city council of this city."

Notes for JOHN JAMES SHIRLEY:
In "Paulding County Fair Centennial Book, 1872 - 1972," the following may
be found under the heading of Antwerp: "For a long period John J. Shirley
was one of the merchants of the place, and erected the first brick
business room.  The first factory to be established was the Antwerp Stave
Company, about 1860.  It manufactured staves and heading."

The 1860 Census of Caryall Township of Paulding County, Ohio (page 128,
dwelling 516, family 498) show him residing with Lucinda, daughters Mary
E. and Levina, sons Franklin P. and John H. Shirley. Also in the
household were Frances Peck, age 11, a day laborer named Henry Leighty,
age 22, a Mark Miller, age 19, and Robert Shirley, age 18 "att[ending]
school".  The Robert Shirley living with the family is John's 3rd cousin
(Robert was the son of James and Elizabeth (Gilbert) Shirley, who was the
son Robert and Rachel (Gilbert) Shirley, who was the son of James
Shirley, who was the son of the Founder Walter Shirley, Sr.)

According to "A Century of Progress, Antwerp, Ohio, Souvenir Edition 1841
- 1941," John J. Shirley was a signatory of a December 30, 1863, petition
to the County Commissioners of Paulding County, Ohio, requesting that the
village of Antwerp be incorporated.

John J. Shirley served as a Captain in Company  A, 132nd Regiment, of the
Ohio Volunteer Infantry (National Guard). He enrolled on May 2, 1864 and
was mustered in at Camp Chase, Ohio, on May 14, 1864, for a period of 100
days.  When mustered in he was said to be 38 years old; occupation
merchant; had grey eyes, light hair and complexion, and stood 5 feet 8
inches in height.  There appears in his Civil War Service file a letter
which reads as follows:

"Toledo, Ohio, August 8th, 1864
Hon. E.M. Stanton
Sec. of War
Hon.Sir
Doctor A. McDaniels and Mrs. J.J. Shirley wife of Captain J.J. Shirely of
Company A. 132 Regiment Ohio National Guard unit writes Washington to
obtain a pass to go to Fortress Monroe to bring her husband home. The
Capt. is sick at Che__ake [?] Hospital Fort Monroe.  I need not say that
they are loyal and entitled to the confidence of the Government.
I trust you will give them the pass they ask.
Respectfully __ Ashley"

John was mustered out with the Company on September 10, 1864.

An advertisement in the "Paulding Co. Press" of April 23, 1868, reads:
"New Grocery Store - John J. Shirley has just open a New Grocery Store
near his old stand at Antwerp, Ohio...."  The lengthy ad goes on to list
a myriad of products for sale.

John J. Shirley's obituary notice appeared on page 2 of the March 7,
1872, edition of the Antwerp Gazette as follows: "J.J. Shirley. Died--At
Antwerp, March 4, 1872, after a prolonged illness, John J, Shirley, aged
46 years, 5 months and 13 days.  The deceased has been a resident of
Antwerp about fifteen years, during which time he has been actively
engaged in business, and indeed for eight or ten years he has done the
leading business in Antwerp.  At the time of his death he owned a half of
the Stave Factory of Shirley and Harris, was also in the mercantile
business.  He has ever been liberal in forwarding all matters of public
interest in Antwerp, and the people will feel his loss very severely.  He
was a generous, active, enterprising business man, and we feel his place
will be hard to fill. His funeral, which took place under the auspices of
the Masons, at the B. _ Church on Wednesday afternoon at 3 o'clock, was
probably the largest ever known in Antwerp.  Only a small portion of the
crowd could get into the church.  The bereaved family have our deepest
sympathy in their affliction."

The March 28th, 1872, edition of the Antwerp Gazette published on page 2
a resolution of mourning adopted by the Antwerp Lodge No. 335, F.&A.M.,
and the October 16, 1873, edition of the paper carried  an item on page 3
remarking on the stone monument being erected at the cemetery in memory
of John J. Shirley.

John J. Shirley did not leave a Will.  As a result, the disposition of
his Estate fell to appointed Administrators Marshal Wilson and Frederick
Chapin, and the Probate Court.  The Court records show that John had
considerable land and business holdings.  His personal assets were shown
to be $26,537.34. Unfortunately, at his death his personal assets were
"...wholly insufficient to pay his debts and charges of administering
said estate."  Lucinda was assigned a Dower Right of $2,000.00.  It is
believed that Lavina may well have ended up with more than just her
Dower, for in her Will she leaves her "Antwerp property" and the rents
and profits from the same to daughter Lavina.

Notes for LUCINDA CATHERINE PEFLEY:
Lucinda Catherine Pefley was born in Viginia (probably in Botetourt
County) on August 16, 1828, to Jacob and Mary (Myers) Pefley.  Lucinda
was 4 years old when she, her parents and 2 brothers removed to Ohio.

The January 20, 1848, marriage of Lucinda Catherine Pefly to John J.
Shirley is recorded in the Defiance County, Ohio, Record of Marriages
Vol. Small 1, page 21.  Following the death of John, Lucinda married 2nd
to the Rev. Charles Hoag (the brother of her son-in-law Myron Chester
Hoag). This marriage took place on October 14, 1873.

The October 23, 1873, edition of the Antwerp Gazette carried the
following item on page 2 concerning her marriage to Charles Hoag:
"Married On Tuesday, Oct. 14th. 1873, at Toledo, Ohio, by Bro. S.S.
Barter, Rev. Charles Hoag, of Central Ohio Conference, to Mrs. Lucinda C.
Shirley, of Antwerp, Ohio.  The happy couple arrived at Antwerp on the
2:30 p.m. train, on Saturday and repaired to the residence of the bride;
and in the evening a grand reception was given, which was a very fine
affair and reflects great credit upon her children. The invited guests
assembled at an early hour and were ushered into the parlor where the
bride and groom awaited their congratulation. We could not but note how
charming she looked in her quite bridal array, and how her dark eyes
glowed, and her face beamed with joyous trust, giving us an assurance of
happiness unmingled with fear for the future.  The Antwerp Cornet Band
was present, and gave their congratulations in the form of some very fine
music, and all passed merrily on 'til the hour of nine when the guest
repaired to the dinning room, where a sumptuous repast was served.  The
table was beautifully arranged, and filled with every desirable luxury,
the most attractive feature being the brides cake, in the form of a
beautiful pyramid handsomely decorated, and surmounted by two clasped
hands, a beautiful emblem for the occasion.  The evening passed rapidly
away and are ushering in of another day the guests had all departed, and
left behind them their sincere wishes for their future happiness.  May
brother Hoag never have cause to regret his many bachelor days, and in
the noonday of his wedded life, may the sweet golden days glide not too
swiftly away."

Lucinda's obituary appears in the November 23, 1893, edition of the
Antwerp Argus.  It reads: "On Monday, Nov. 20, Mrs. Lucinda C. Hoag died
at her home in Toledo, O., aged 65 years, 3 months and 6 days. Her
remains were brought to Antwerp, Wednesday, and funeral services were
held in the M.E. church, Rev. John E. Wean, officiating. Interment took
place in the Antwerp Cemetery.  Mrs. Hoag was formerly a resident of
Antwerp, being among the early residents of the village.  Her late
husband, Mr. John Shirley, who died some years ago, being one of the
first business men in the town, and many conspicuous marks of his
enterprise are yet seen in the village."

The Lucas County, Ohio, Probate Court held a hearing on December 30,
1893, in the matter of Lucinda's Will (Adm. Docket No. 770, Vol.2, p.
770).  In court Lucinda's Will was produced,  but her signature and those
of the witnesses to her signature "had been, by some person unknown,
removed by cutting the same from said paper-writing."  The witnesses were
produced, and the Will accepted.  Lucinda bequeathed to daughter Lavina
her "homestead consisting of a house and barn in North Toledo, Ohio,"
together with 14 lots where the house and barn stood. Lavina also was to
receive the rents and profits from her property until such time as her
daughter Mary reached age 21.  Her grand-Daughters L. Clark was to
receive $1,000.00 when aged 21.  After Lavina's death, grand-daughter
Mary Hoag was to receive the property givin to Lavina.

collection of short stories, alledged by the author to have a factual
basis.  "The Hermit of the Otter Rock" story  is said to refer to Walter
Shirley.  To which Walter Shirley--Junior of Senior--this story is meant
to refer, and what, if any part of this story is based on fact as opposed
to "family tradition" has confounded this writer for many years.

Notes for LAVINA ELIZABETH SHIRLEY:
Lavina (Shirley) Hoag appeared in Probate Court in Lucas County, Ohio, on
 December 30, 1893, to testify as to the authenticity of her mother's
Will; her signature and witnesses names had been cut from the Will "by
some person unknown".  Lavina was bequeathed her mother's "homestead
consisting of a house and barn in North Toledo, Lucas County, Ohio,"
where she was then living, "together with fourteen (14) lots on which
said house and barn stands."  Lavina was also to receive the rents and
profits of her "Antwerp property" until her daughter Mary Shirley became
21 years of age.

It is not known if Lavina traveled from California to Ohio in the company
of Myron for her appearance in Probate Court (they had divorced at an
unknown date).  It is known that they were living apart in 1900.

Myron is found in the 1900 Census living in Tulare, California.  Lavina
may be found as "Vine Hoag" in the 1900 Census of San Francisco, 43
Assembly District, Enumeration District No. 279, Line 84, page 300B,
living on Prospect Street with the family of N'g Sing. Her occupation is
shown as "Teacher."  She was in fact a Missionary to the Chinese.  In
Myron's pension file he asserts that he never lived in San Francisco.

Lavina survived the great April 18, 1906, earthquake and fire in San
Francisco, and was forced for a time to live in a tent city erected to
house those made homeless by the disaster.  She continued her Missionary
work in San Francisco until a few years before her death.

Notes for DR. MYRON CHESTER HOAG:
Myron Chester Hoag was born in Toledo, Ohio.  At aged 18 he enlisted in
the U.S. Army for a period of one year, and was mustered into Company K
of the 2nd Regiment of the Ohio Heavy Artillery Volunteers on August 30,
1864.  At enlistment he was said to be a Wagon Maker, had grey eyes,
light hair, fair complexion, and stood 5 feet 4 inches tall.  Apparently
having sight in only one eye did not prevent his enlistment.  He was
mustered out at Knoxville, Tennessee, on June 17, 1865.

In Waggoner's "Toledo & Area History" it is noted on page 554 that in
1875 "M. C. Hoag admitted as member of Toledo Medical Association."

Not long his marriage to Lavina Shirley they left Ohio and are next found
in Bakersfield, California, where daughter Mary Genevieve Hoag was born
(on January 6, 1877), and Myron registered to vote (on June 9, 1877).  At
an unknown date prior to 1900 Myron and Lavina divorced.

On June 8, 1896, Myron applied for a disability pension because of his
failing health.   In his application he remarks that on March of 1861 he
was struck in the eye by "a flying stick received while splitting wood
for fuel,"  and lost the sight of that eye, and that "the curtain of the
injured eye is grown into the wound in front of the eyeball and occasions
almost constant pain."  By this time the vision in his left eye failed
about 50 percent.  In May, 1888, he was kicked in the leg by a horse
causing a sever fracture. He stated that "At the place of the fracture
there is an enlargement of the limb which is tender and painful so that
the leg cannot be used for any length of time, also being unable to step
from a street car, or buggy step with said leg."  His pension certificate
was No. 1087230.

By 1904 Myron's health had further deteriorated and he applied for an
increase in his pension (from the $8.00 a month he was then receiving).
He had by now developed heart trouble, rheumatism, and severe varicose
veins that required wrapping.  At this time he was living with his
daughter Mary ("May") and her husband Edson Riggs Williams in Sacramento,
California.

Myron notes in the application for pension increase that since his Army
discharge he lived in "Toledo, Ohio, till 1876, then moved to Cal. Lived
at Bakersfield, Fresno, Kings River, and Exeter."  Myron spent the later
years of his life in Sawtelle (now part of Los Angeles), California.

Notes for EDSON RIGGS WILLIAMS:
At about age 6 Edson Riggs Williams removed with his parents from Pawnee
Station, Bourbon County, Kansas, to the vicinity of Bakersfield,
California.  As a young man he entered the employ of the Southern Pacific
Railroad as a machinist apprentice.  During his employ he suffered two
serious accidents.  In the first he lost an eye as a result of a flying
piece of steel getting in it.  Several years later an engine cab on which
he was working fell on him and so severely injured one of his legs that
it required amputation.  His father-in-law, Dr. Myron Chester Hoag, rode
on horse back from the Los Angeles area to attend him after the
amputation (he was said to remark that it was one of the worst jobs of
amputation her had ever seen).

Realizing he was now handicapped in learning his trade, he gave it up and
entered the Scranton School of Correspondence as a student in the
Engineering Department, and passed his examination with high marks.
Shortly after his graduation he applied to the Southern Pacific for work,
and was given a position with H. J. Small at Sacramento, California, in
the Drafting Department.

On May 11, 1915, during his employ with the Souther Pacific, Edson
invented and patented a so-called "Disappearing Switch" (U.S. Patent
#1,139,148). This device employed a "disappearing signal target and light
for railroad tack switches."   In his patent he claims that "The
advantage of such a construction is that when a switch is not in use the
light and target is below the surface of the ground in a covered box,
thus leaving the space clear, and by doing so lessens the hazard of
accidents.  The operation of the switch will cause the light and target
to appear above the surface of the ground.  It eliminates the many lights
that face the engineer when going through a yard, and lessens his
confusion and possible accident to train and yardmen."  This device was
given a trial in the Southern Pacific's Bakersfield Rail Yard, but was
not widely accepted.  Edson received his patent under the name Edison
Williams  Though he used this name in later life, his true name was in
fact Edson, the name being taken after his Uncle Edson Williams.

Edson remained in the employ of the Souther Pacific Railroad until his
death on July 21, 1925, at the Southern Pacific Hospital in San
Francisco.  At his death he was a Civil Engineer stationed at the
Company's Sacramento Headquarters, and held the position of Assistant
Division Engineer for Bridge and Building.
