Foote family of London and Prince William Co. Virginia

King James granted three Londoners and Virginia Catholic George Brent rights of religious freedom for the settlement of French Huguenots on the 30,000 acre (121 km²) Brenttown (Brenton) tract in old Prince William County, Virginia in 1687. Richard Foote, nephew of Nicholas Hayward (one of the founding partners), settled at Chotank in King George County, Virginia to manage the project. Nicholas Hayward marketed Brenttown to English Catholics after the Glorious Revolution eliminated most political reasons for French Protestants to leave England.

LW& T of Richard Foote, Sr (bequeaths lands in Virginia)

Will of Richard Foote, merchant, of London:

His personal estate to be divided into three parts according to the custom
of the City of London: one third to his wife Hester Foote (in full of his
personal estate except as elsewhere bequeathed to her); one third to be
divided among his five children Richard, George, Sarah,
Francis and Henry, the rest of his children (Samuel Foote and testator's
daughter Elizabeth Holmes) being already provided for; from the other third,
100 Pounds [money] to Samuel Foote. (It is not clear whether legacies below
also come from this last third.)

To Elizabeth Holmes 200 Pounds.

To Richard Foote 600 Pounds, and 3000 acres of land, part of testator's
lands in Virginia.

To George Foote 100 Pounds and 1000 acres of his land in Virginia.

To Francis Foote and Henry Foote 800 Pounds apiece at 21, and to each 1000
acres of his land in Virginia.

From legacies to Francis and Henry the executors may lay out up to 200
Pounds apiece to Apprentice them; interest on their legacies goes to their
mother for their upkeep.

To his grandson Topham Foote 200 Pounds, which his father Samuel Foote shall
put in trade for him till his majority; also 1500 acres of his land in
Virginia.

The rest of his estate to his wife Hester Foote, who is named joint executor
with his son Samuel Foote.

Signed 19 March 1694. Witness James Stone, Richard Stracey, Ran. Stacey.

Probate London 23 April 1697 to Hester Foote, the other executor Samuel
Foote being dead.

P.A.B. identifies testator with the parish of St. Dunstan in the East,
London, perhaps his place of residence.

 

Information on George Foote of Fauquier County Virginia, son of Richard Foote Jr

George lived at first in St. Paul's Parish, Stafford Co, VA. Later hemoved to Fauquier C, where he was at his death. He married twice. Hissecond wife Mary is named in his will. The will was proved in FauquierCo, June 28, 1759. Legatees were his wife, and sons: William, Richard,Henry, George and Gilson, and his daughters: Elizabeth, Frances andBeheathland. he directs that his youngest sons Richard and William shall be educated. The others were probably grown. VMHB, pp cit pg 97

Will was presented to the court by Gilson Foote, one of the Executorstherein named who make Oath thereto and the same being proved byBrereton Jones, William Fletcher, John Burdett, George Bussell,witnesses thereto.

George Foote died before 28 Jun 1759 in Fauquier Co, VA. His estate was probaterd on 28 June 1759 inFauquier Co, VA. His estate appearedin probation in 1760 in Fauquier Co, VA. His estate was named in the"Virginia Publick Claims"-Property used during Rev War on 25 Mar 1782in Fauquier Co, VA DAR application #677800 (Note: This was either hisestate or his son George, which it well might be)

George's portions of his father's 25% of the 30,000 access of BrentTown fell in Prince William and what would later become Fauquier Co,West of Cedar Run. George's share included land on Champ's Run, northof Town Run, and other acerage on Cedar Run. For his home site heselected 295 acres within two miles of the old Brent Town on theShenandoah Hunting path. There, a small community still existed andincluded in a few years Harding's Inn or "Ordinary" as inns werecalled, and Elk Run Church. (note from Brian Foote, rec'vd on Aug 11998, "PS".

Four of the sons of George Foote, deceased, whearashereto for many years ago and George Brent, Robert Bristow, NicholasHayward and Richard Foote, grandfather of the first named Richard Foote, party to these presents obtained a patent from the thenproprietor of the Northern Neck of Virginia for 30,000 acres of landknown by the name of Brent Tract as by the said patent may fullyappear and whereas at the death of said Richard Foote the patentee'sundivided fourth part of the said Brent Town land descended to his sonRichard Foote, the father of the first named Richard, who having beenseized of the said undivided fourth part in his demise as of feesimple made his last will and testament in writing (as isfully statedin the opening pages of Mr Watson's information of the Foote Family).

In 1772 Settlement ofsuit re Foote family's share of 30,000 acres Brent Town tract patentedby George Brent, Robert Bristow, Nicholas Hayward, and his grandfatherRichard Foote; on latter's death 1/4 undivided share descended to hisfather Richard, who willed 800 acres to two daus, balance to sons:him, George, and John; last died intestate without issue and sharefell to him as oldest son; Brentown divided and he divided 7500 acresaccording to father's will; bro. George willed his part to sons Henry,George, Gilson, Richard and William; Henry sold to William Stuart;resurvey showed original division had shorted the Foote 7500 acresshare by 1450 acres, all in subsequent division coming out of his ownpart; he accepts settlement with his nephews; with AbsalomXRamey,Benjamin Pope , James XDrummond.
