1771; He apparently died before the 1810 census when wife Elizabeth
was enumerated in Bedford county as head of household.
married Elizabeth Shields on 17 November 1791 (by license)
in Bedford Co VA; She was the daughter of Elenor Shields who
gave consent to her 1791 marriage; She and Eleanor/Ellinder [surname?]
inherited 150 acres on Holsten Nob from William Ewing in 1810.
Enumerated in the 1830 Bedford Co VA census (age 70-80); In 1819,
Mitchell Ewing sold 100 acres of land on Holsten's Nob that he
inherited from William Ewing to Elizabeth Shirley and Ellinder
Shields. In 1831, Elizabeth and her son Joseph (apparently) mortgaged
all of their personal household good for $44.30 to be repaid
in six months. She was deposed and gave testimony in the 1830s
Chancery lawsuit involving her son Joseph (he is so named in
the suit) and Moses Parker regarding a horse purchased from Parker
in 1830 for $45. She is enumerated in the 1840 census (age 70-80);
In 1844, she and son Joseph once again mortgage their personal
and real property (items identified in the document); This debt
was apparently unpaid and in 1851 following her death, the list
of property (items listed, including 100 acres of land) was sold
according to a deed of trust. She apparently died prior to the
1850 census.

1(i). Joseph Shirley He was a soldier in the War of
1812. He enlisted as a private at the age of 18 and served six
months in Capt Green's 5th Regiment of VA militia from 27 Feb
to 20 June 1814; born in Bedford Co Va; occupation farmer; was
very tall, with auburn hair, blue eyes and fair skin. Joseph
first appeared in Bedford Co records in the 1815 estate administraation
of John Stretch of Bedford Co VA; He appeared in the 1820 Bedford
Co VA census (b 1794-1804), but not found in 1830, living in
the household of his mother Elizabeth Shirley (he age 30-40,
she age 70-80); On Jan 30, 1830 he purchased a chestnut sorrel
horse from Moses Parker. This purchase led to a Chancery dispute,
Shirley claiming that Parker misrepresented the poor health of
the horse at time of purchase for $45 (Bedford Court Sept 1832,
Note: one of the depositions in the lawsuit confirms that Joseph
Shirley was living at the residence of "Mrs Shirley").
Parker and other witnesses claimed that the horse was injured
while in Shirley's possession, one witness claiming that Shirley
said he would try to "scare" Parker to drop his own
suit and that he would eventually pay for the horse. Shirley
filed suit against Parker after the horse died. Court records
appear to award judgement to Parker. He and his wife and children
are once again enumerated in his mother's 1840 census household;
He died 18 March 1848 (source: widow's veteran pension application)
married 1) Nancy Carter; Marriage record not found
in Bedford VA, but she is identified in a Virginia chancery lawsuit;
She was said to have been abandoned by husband Joseph Shirley
in 1838 (divorced?); She is alive in 1859 giving consent to the
marriage of her daughter Sarah. She was supposedly the daughter
of Fleming Carter of Bedford Co VA
married 2) Eliza Ellett Elder on 6 February 1840 by
license in Bedford Co VA at the "widow Otey's house";
Enumerated as head of household in 1850 Bedford census, apparently
as a widow, age 34. She purchased a few items of her husband
and mother-in-law's property that was sold in 1851 deed of trust;
She filed a War of 1812 widow's pension application stating that
"neither she nor her husband were previously married".
She is enumerated in Bedford Co VA in 1860, age 50; [not found
in 1870 census] She moved to Rockbridge Co VA in 1874; She was
enumerated at Natural Bridge in the Rockbridge VA census in 1880,
age 80. She died 8 Aug 1880

(age 5-10 in mother's 1840 census); Sent to live with William
and Tabitha Carter and appears in their 1850 census household
(age 15), then lived with Braxton and Mary Carter according to
family tradition, and used the Carter name; Supposedly, he appears
as Joseph P Carter in Bedford 1860 census, age 22. nothing
more known
2(iii). Eliza Shirley born about 1830-35 (age 5-10
in mother's 1840 census); Sent to live with Braxton and Mary
Carter and was said to use the Carter name; However, she is enumerated
in her step-mother's 1850 household as Eliza Shirley, age 20
2(iv). Sarah Jane Francis Carter (Shirley) born 2 March
1837 in Bedford Co VA; She was age 0-5 in mother's 1840 census;
Sent to live with William and Tabitha Carter and appears in their
1850 census household, then lived with Braxton and Mary Carter.
She married her first cousin George W. Carter in Bedford Co VA
on 12 October1859 (son of Littleberry Carter who was the brother
of her mother Nancy Carter Shirley). Consent for the marriage
was granted by her mother. He died February 1862 and she married
George P Carter about 1867; She died 31 August 1921 at Winston
Salem, Forsyth Co NC
2(v). Mary Shirley born about 1840, age 10 in her mother's
1850 household; likely the M Shirley living in the William Agnew
household in Bedford Va 1860 census, age 22
2(vi). Daniel M. Shirley born about 1842, age 8 in
his mother's 1850 household; Living in the James Chitton/Chilton
household in the Bedford VA 1860 census, age 15, as farm laborer.
Likely the same Daniel M Shirley who served 20th Battalion, Virginia
Heavy Artillery Co C in the CSA during the Civil War. He was
age 35 in Bedford Co VA 1870 census (with Elizabeth Shirley age
30). Age 48 (sic) living in his mother's Rockbridge VA household
in 1880; He may have not married.
2(vii). Ann Eliza Shirley born about 1844-47, age 6
in her mother's 1850 household, age 14 in her mother's Bedford
VA 1860 household, age 33 in her mother's Rockbridge VA household
in 1880; In 1881, she swore with her sister Lucy to the date
of death of her mother (found in pension documents), apparently
unmarried.
2(viii). Lucy E. Shirley born about 1847-8, age 3 in
her mother's 1850 household; Living with Hudson Cobb household
in 1860 Bedford VA census, age 15; She married William E Fraizier,
son of Thomas and Elizabeth Fraizier on 19 June 1867 in Bedford
Co VA (her parents named)
1(ii). Eleanor (Ellender) Shirley She was deposed and
gave testimony in the 1830s Chancery lawsuit involving her brother
Joseph (he is so named in the suit) and Moses Parker regarding
a horse purchased from Parker in 1830 for $45. Nothing more
known

born about 1827-1833 in Bedford Co VA; He purchased a sorrell
mare in the estate of Joseph Shirley; He is enumerated with his
step mother Eliza Shirley in Bedford Co in 1850, age 23; He is
enumerated in the 1860 census of Botetourt Co. VA, with wife
Nancy S. and a son Bob D. 1 year of age (living next to Camper
family); He served in the 28th Reg't VA Infantry Co. A. Confederate
Army. He died of pneumonia in a hospital in Staunton Virginia
during the Civil War on Nov 6, 1862.
married Nancy S. Camper. She was born 1841; She married
2nd Jacob Winger 1868. Nancy Winger filed for a confederate widow's
pension to the State of Virginia based on the service of her
first husband Edward Shirley (see the Library of Virginia website
for online images of her application ); She died 1930.
