1(vi). Robert Shirley was born about 1738 in Virginia. He was named
in his father's 1755 will as the youngest son. He inherited 183
acres of land being the plantation where his father lived. He
appears on Berkeley Co VA (later WV) rent rolls for 1774/81 with
183 acres. He applied for a claim for public service during the
Revolutionary War in 1780-83. He next appeared in Berkeley Co
land owners books in 1784 and 1790, on land that was included
in Jefferson Co VA (WV) in 1801. He died 3 April 1813 in Jefferson
County, West Virginia.
1814 January 13 Farmer's Repository (newspaper) "At
a court continued and held for Jefferson county, December 27,
1813. Patience Shirley and Mary Shirley, Infants under the age
of 21, by John Shirley their father and next friend, Pltfs. vs,
Walter Shirley, Robert Shirley, John Shirley, jr., Cyrus Hibbin,
and Elizabeth his wife, and Patience Shirley, widow of Robert
Shirley, deceased, Dfts. IN CHANCERY. This day came the plaintiffs
by their counsel, and the defendant Robert Shirley not having
entered his appearance and given security according to the act
of assembly and the rules of this court, and it appearing to
the satisfaction of this court that said Robert Shirley is not
an inhabitant of this Commonwealth; on the motion of the plaintiffs
by their Counsel, it is ordered that the said Robert Shirley
do appear here on the fourth Monday in February next, and answer
the bill of the plaintiff, and that a copy of this order be forthwith
inserted in the Farmer's Repository for two months successively
and posted at the door of the Court House of the said County.

of the personal estate of Robert Shirley dec'd dated 15
Oct 1813, John Tolbot, Thos H Grady, Wm Stanhope
married Patience _________ She sold her Dower Right
to the property owned by son Walter to Michael Wysong on November
9, 1814 (Jefferson County Deed Book 9, Page 473)

2(i). Robert Shirley Jr. born in Virginia. On January
18, 1819 Robert Shirley sold his share of land inherited from
his father to a Joseph Janes of "the town and County of
St. Louis and Territory of Missouri" for the sum of $1,000
(Jefferson County, West Virginia Deed Book 11, Pages 1 and 2).

2(ii). John Shirley born Virginia He died about 1822
in Jefferson County, West Virginia. John Shirley is identified
as the son and heir of Robert Shirley in a 12 Aug 1813
Indenture found in Deed Book 8, Page 251. In a 15 Oct 1817
Indenture found in Deed Book 10, Page 249, John acquired his
Mother Patience's Dower Right to the land of her husband and
his Father for payment of purchases made by him for her at Robert's
Estate Sale. By Indenture dated 30 Mar 1818 (Will Book
10, Page 265) John sold the property conveyed to him "...by
Patience Shirley, his mother." John Shirley probably died
early in the year 1822. An appraisment of the Estate of
"John Shirley, Dec'd" was made March 6, 1822 (Will
Book 3, Page 454), and an accounting of its sale was made on
March 22, 1822 (Will Book 5, pages 282-283).
married Ann Smithey on February 07, 1785 in Berkeley
County, West Virginia.

3(i). Patience Shirley She was under the age of 21
when her father sued the other heirs of Robert Shirley in Chancery
on 27 December 1813. She married John Combs on July 03, 1820,
Washington County, Maryland
3(ii). Mary Shirley She was under the age of 21 when
her father sued the other heirs of Robert Shirley in Chancery
on 27 December 1813. She married Thomas Austin on December 13,
1816, Washington County, Maryland
3(iii). David Shirley, born about 1801.He lived in
Jefferson Co VA (later WV) in 1850 census. He died January 26,
1873.
married Caroline McKnight on February 21, 1828 in Jefferson
County, West Virginia. She was born Abt. 1801, and died
October 01, 1880 in Jefferson County, West Virginia.

4(i). John J. Shirley born about 1831, age 19 in 1850
census; He lived in Jefferson Co VA (WV) in 1860 census. Lived
at Shepherdstown Jefferson Co WV in 1870 census; He died July
24, 1896, Jefferson County, West Virginia.
married Ann Elizabeth Hosier on July 13, 1853 in Jefferson
County, West Virginia. She was born July 15, 1828, and
died June 02, 1905 in Jefferson County, West Virginia.

5(i). Laura Shirley born about 1854, age 6 in 1860
census, age 16 in 1870 census
5(ii). Alice Shirley born about 1857, age 3 in 1860
census, age 14 in 1870 census
5(i). Cora Shirley, born August 4, 1857, Jefferson
County, West Virginia, age 12 in 1870 census; She married James
H. Miller on December 10, 1879, Jefferson County, West Virginia.
She died July 03, 1901, Jefferson County, West Virginia.
5(iii). Lewis Jefferson Shirley born about 1859, age
0 in 1860 census, age 11 in 1870 census, Living in Nagly household
in 1880 census, single age 20, occupation shoemaker; Married
and living at Charles Inn, Jefferson Co WV in 1910 census; He
died 9 Nov 1937 at Jefferson, West Virginia

4(ii). Mary F Shirley born June 1833. She married George
W Barringer, 4 Nov 1848 in Frederick County MD. She died 26 Jan
1918 in Kendallville, Noble IN while staying with her daughter
and was buried in Ferncliff cemetery, Springfield, Clark County,
Ohio where she lived after the civil war with her family.(added

4(v). Eliza Shirley, born about 1842, age 8 in 1850
census.
2(iii). Walter Shirley, born say 1770s Virginia;
He was enumerated in the Berkeley Co (West) Virginia tax list
as Walter "Jr" in 1800; After Jefferson Co (West) Virginia
was formed from Berkeley Co, Walter was enumerated in that county
in 1810 census; He and his wife had 6 male children enumerated
in the household; He was named as a defendant in Chancery as
an heir to the estate of Robert Shirley on 27 December 1814.
He borrowed money using his 1/5th share of his father Robert
Shirley's land in 1814 (DB 8 pg 273) In the same year, Walter
appointed Ephraim Shirley his attorney to sell his part of his
father's land due to troubles in a lawsuite in Superior Court
(DB 8 pg 286); He and Elizabeth finally sold the 53 acres inherited
from his father to Michael Wysong for $1,000 in late 1814 (DB
8 pg 485) and his various debts recorded as satisfied; In June
of 1816 Walter, then 'of Frederick County' assigned over the
balance of his father's personal estate to John McGinnis (DB
9 pg 395) Editor: At this point, it is tricky to differentiate
between this Walter Shirley in deed records and a younger Walter,
son of Jarvis Shirley Sr of Jefferson Co WV who was given land
by his father in 1818, begins to appear w/brother William Shirley
in deed records and who seems to be living w/widowed mother on
father Jarvis' land (thus not in census); Walter Shirley
was enumerated in Jefferson Co WV in 1820 census with a large
and aging family; Not found in 1830 census (Walter s/o Jarvis
is age 40-50 w/wife and only 1 young daughter in 1830 census)
married Elizabeth Stanford on 10 May 1794 at Berkeley
County, (West) Virginia; She is identified as Walter's wife in
several of her husband's Jefferson Co WV deed registrations in
1814.

She married Cyrus Hibben on December 22, 1805, Jefferson County,
West Virginia. Elizabeth (Shirley) Hibben lost the land inherited
from her father to satisfy the debts of her husband Cyrus.
The property was sold at a Sheriff's sale and purchased by James
Lock on September 9, 1818 (Deed Book 10, page 385, Jefferson
County, WV). Elizabeth later sold her Dower Right to the
property to James Lock on October 31, 1822 (Jefferson County
Deed Book 12, Page 354).
