1(iii). James Shirley Sr.
was born about 1732, likely in Maryland. He died about 1785 in
Berkeley County, (West) Virginia. James Shirley, with his
brothers, lived on the parental plantation near Keyes Ferry,
later named Millville, (West) Virginia. On March 8, 1773,
James undertook to break the entail of his father's Will by conveying
his property to Thomas Rutherford. James's brothers united
with him in this effort, and clear title to James' land passed
to Thomas Rutherford on September 15, 1774. This Deed is
recorded in Deed Book 3, page 8, in Martinsburg, West Virginia.
James Shirley served in the French and Indian Wars under Captain
Robert Rutherford, as did his brothers Walter and Jarvis.
In 1780 James made application for a Bounty Land Warrant for
the services he rendered in 1758 and 1759 (see: French and Indian
Bounty Warrants, Vol. 2, p. 356, Virginia Land Office, Richmond,
Virginia), In Old Military and Importation Warrants, Vols, 1,
2 and 3, p. 862, Virginia Land Office, Richmond, Virginia, may
be found the following:
"Land Office Warrant, No. 1064 To the principle surveyor
of any county within the Commonwealth of Virginia: This shall
be your warrant to survey and lay off in one or more surveys,
for James Shirley his heirs and assigns, the quality of fifty
acres of land, due to said James, for military service performed
by him as a soldier in the late war between Great Britain and
France according to the terms of the King of Great Britian's
proclamation of 1763 a certificate of which Duly proven is received
into the land office on this 25th day of May in the year of one
thousand seven hundred and eighty."
The land James acquired was "in the County of Monongalia
on the West side of the Little Kenhawa." He later
signed over the land to Robert Rutherford. This assignment was
certified by Patrick Henry, Governor of the Commonwealth of Virginia
on July 5, 1785, and is noted in a continuation of the record
cited above. It was apparently during this same year that
James Shirley died, since his name disappeared from the 1785
tax rolls of Berkeley County.

1820 census of Bourbon Co KY. He appears in the 1820 Bourbon
Co KY census for the Millersburg Township. He and his wife has
5 sons and 2 daughters in his household. He also appears on the
1828, 1829 and 1830 Bourbon Co tax lists. He died about 1833
in Bourbon Co KY. His estate inventory was appraised by John
Shirley (Jr). A Lucy Shirley was named as the primary buyer of

- Mrs Laura Wilkerson Shirley wife of Dr James A Shirley died
Sunday morning at her home on Maysville Street Mrs Shirley had
been ill for several weeks but her condition did not become alarming
until Thursday evening at which time she became unconscious and
never rallied, passing away without a struggle, acute kidney
trouble being given as the cause. Mrs Shirley was 59 years old
and was born and reared in this county. She was a lovely and
attractive woman and was deeply attached to her home life but
always found tim to help those in trouble and distress. Besides
her husband Mrs Shirley is survived by two children Mrs James
K Shropshire and Miss Flo Shirley and two sisters Mrs W.B. Greene
and Mrs Richard J Hunt all of this city. The funeral of Mrs Shirley
will be the Christian church of which she was a devoted member
Monday afternoon at 1 oclock and the burial will occur in Machpeloh
cemetery. Rev H D Clark pastor of the church will preach thee

Lexington Herald - June 6, 1920 - Winchester, Ky. June
8 - Dr. I.A. Shirley, 71 years old, one of the most prominent
physicians of the state, died this morning at his home in South
Highland street of heart disease. Dr. Shirley was a native of
Bourbon county. Dr. Shirley was Clark county health officer and
a member of the State Board of Health and Rockefeller Health
Commission. He has worked to eradicate hookwork and trachoma
in the mountains of Kentucky. He was succeddful in general practice
here. Dr. Shirley was counciler for this district and district
sanitary inspector. He was formerly president of the Kentucky
Medical Association, having held every office in the gift of
the organization. He has missed attendence at only two state
meetings in the last thirty-five years. He was president of the
Clark County Medical Association several times. Dr. Shirley was
a graduate of the University of Louisville and eastern medical
colleges. Dr. Shirley was a deacon of the First Chirstian Church.
He is survived by his widow, who was Miss Clay Bradley, of this
county; one daughter, Mrs. Mae Shirley Johnson, and a grandson,
William Shirley Johnson; a brother, Dr. J.A. Shirley, 73 years
old, physician of Mt. Sterling. Funeral services will be held
Sunday afternoon at 3 o'clock at the residence conducted by the
Rev. J.H. MacNeil and Dr. G.W. Banks, with burial in the Winchester
Cemetery.

2(iii). James
Shirley born 24 February 1768, Frederick County, Virginia;
He died 16 January 1840, Charles Town, Jefferson County, West
Virginia. When a young man, and about the time of his father's
death, James Shirley moved to the vicinity of Smithfield, Virginia
(now Middleway, West Virginia). He owned large properties,
and continued to add to his possessions during his life, and
died owning a large estate. James Shirley's Will is recorded
in Jefferson County, West Virginia, Will Book 9, Page 409.
In it he gives his wife Matilda one third of his estate "both
real and personal," stipulating that after her death
her Dower was then to be equally divided between his sons Robert,
George William, and Thomas Lee. The remaining two thirds
of his holdings were distributed to sons Robert, George and Thomas.
At his death James Shirley owned numerous tracts of land amounting
to considerable acreage. A Plat of some of James' extensive holdings
may be found in Will Book Book 24, Page 309, of Jefferson
County. James gave his sons several slaves by name. All
other slaves not named in the Will were to be equally divided
among them (in an estate accounting all are named). James
did will that "my yellow boy named James Rust shall be free
at the age of twenty one years at which time my executor hereafter
named shall out of my estate furnish him with two good suits
of clothes of good quality, and twenty five dollars in cash."
In the accounting of the estate the cost of Mr. Rust's two suits
of clothing came to $57.54 (W.B. 10, p. 11). To his daughter
Mary Hurst he gave "two Negroes by name Jerry and Lucy,"
and $1,000.00 cash. Burial: Episcopal & Masonic Cemetery,

married 1) Ruth Hiatt on March 05, 1793 in Berkeley
County, (West) Virginia, daughter of John Hiatt. She was
born April 30, 1756, and died April 1817 in Charles Town, (West)
Virginia. Ruth (Hiatt) Frier was the widow of Alexander Frier,
Jr. at her marriage to James Shirley. Ruth's Father John Hiatt
was an early settler in the region. Burial: Episcopal & Masonic
Cemetery, Middleway, West Virginia
married 2) Matilda Vinson on December 26, 1821 in Frederick
County, Virginia. She was born 1795 in Montgomery County,
Maryland, and died September 17, 1855 in Jefferson County (West)
Virginia . According to Carmen W. Creamer of Locust Grove in
Jefferson County, West Virginia, Matilda Vinson was a friend
made at school by Mary Shirley, daughter of James Shirley and
his first wife Ruth Hiatt. Mary invited Matilda to her
home in Jefferson County where she met and later married Mary's
father James. It is said Mary and her brother James disapproved
to their father's marriage because of Matilda's age (they were
about the same age as their new step-mother). Burial: Masonic

2(iv). Robert
Shirley, born about. 1770, Frederick County, Virginia; He
died 1836, Williams County, Ohio. Robert Shirley sold the Jefferson
County land inherited from his father on April 1, 1808 to John
Zuber for $1,248.75 (Jefferson Co. Will Book 4, Page 528). A
short biography of Robert appears at page 389 in Vol. I of "Valley

married Rachel Gilbert on January 28, 1791 in Frederick
County, Virginia, daughter of Nathan Gilbert and Elizabeth Scout.
2(v). Elizabeth Shirley born about 1777; She married
William Johnson on May 02, 1792, Berkeley County, (West) Virginia5.
2(vi). Timothy Shirley, born February 22, 1777, Virginia;
He died 7 July 1861 at Decator, Brown County, Ohio. In Robert
L, Bates "The Story of Smithfield (Middleway), Jefferson
County, West Virginia," it is said that "Timothy Shirley,
at the time of the War of 1812 was a militiaman in Captain Joseph
Grantham's Company, 2nd Battalion, 55th Regiment of Virginia
Militia. In his early days, Timothy Shirley was reputed
to be an athlete, taking pride in his wrestling prowess."
Timothy Shirley's Will was presented in Probate Count of Brown
County, Ohio, on September 4, 1861, designated as Will No. 221.
In it he names his grand children Justinian Garland Shirley,
Mariah Winter Shirley, and Wilshire Shirley. Named as living
with him was Sarah Burbage. Timothy also names his son William
Shirley, and daughters Isabella and Sarah Shirley. Witnesses
to Timothy's will were James Wright and William McColgin, with
James Wright named as Executor. Shirleys

married Ann Burbage on May 03, 1818 in Brown County,
Ohio. She was born July 20, 1796 in Maryland, and died
October 27, 1842 in Decator, Brown County, Ohio.
